Substance Abuse Policy
At BS Luxury Transportation, we are dedicated to upholding a safe and healthy, drug-free work environment.
BS Luxury Transportation takes substance abuse seriously and enforces a strict zero-tolerance policy. The unlawful manufacture, distribution, dispensing, possession, or use of alcohol, controlled substances, drugs, narcotics, or any intoxicant is strictly prohibited by any contractor or employee, whether on BS Luxury Transportation premises or while conducting company business off-premises. Violations of this policy may lead to disciplinary actions, up to and including termination of employment or contract.
To support a safe workplace, BS Luxury Transportation may collect samples (blood, urine, saliva, etc.) and perform testing to detect alcohol, drugs, or other intoxicants. Consent to testing is a requirement for contractors, and refusal may result in the termination of the contractor’s agreement.
Pre-Contract Testing
Prospective contractors are required to complete a substance abuse test after receiving a contract offer. Applicants who test positive will not be permitted to begin work but may reapply 180 days after the date of their last test.
Reasonable Suspicion and Post-Accident Testing
BS Luxury Transportation reserves the right to require substance abuse testing under “reasonable suspicion” or “for cause” that an individual may be in violation of this policy. Contractors involved in an on-the-job accident may also be subject to testing if their actions may have contributed to the incident. All post-accident tests should occur within 24 hours of the accident, and it is the contractor’s responsibility to notify BS Luxury Transportation of any accident. In cases of serious injury, BS Luxury Transportation may access hospital reports to determine if the contractor was under the influence of any intoxicants.
Periodic and Random Testing
Employees and contractors whose work involves hazardous materials or operation of commercial vehicles may be subject to substance abuse testing on a periodic or random basis, without notice.
Customer-Requested Testing
Some clients may require contractors servicing their accounts to be certified “drug-free.” BS Luxury Transportation will honor such requests, conducting necessary testing for contractors handling those accounts.
Positive Test Results and Refusal to Test
Any positive test result or refusal to test will lead to immediate termination of the contractor’s agreement.
Off-the-Job Substance Abuse
Off-premises involvement with illegal drugs that affects job performance may be grounds for severe disciplinary actions, up to and including termination.
Assistance for Contractors
BS Luxury Transportation recognizes that some individuals may need assistance with substance abuse issues and encourages contractors to voluntarily seek help prior to being scheduled for any type of substance abuse test.
Legal Drugs
Contractors using legal drugs that could impact performance or behavior must provide written documentation from a physician regarding their ability to perform assigned duties safely.
Compliance with Federal, State, and Local Regulations
BS Luxury Transportation complies with all relevant federal, state, and local laws and regulations, including those established by the Department of Transportation.
Suspension Pending Test Outcome
BS Luxury Transportation reserves the right to suspend a contractor or employee without pay pending the results of a substance abuse test. If the results are negative, BS Luxury Transportation will reimburse the individual for any lost time due to suspension.
